Maitland (1850-1906) was more than the greatest professional historian of modern times, he was a philosopher who provides a brilliant sketch of how our strange world has come about, particularly in his work on associations and trusts. Yukichi Fukuzawa (1835-1901) more than any other created the institutions of modern Japan. As an outsider he provides a brilliant insight into the heart of the new capitalist and industrial civilization which had emerged in the west.

A Valuable Introduction to Maitland and Fukuzawa

Cambridge anthropologist Alan Macfarlane was a junior colleague of the late Ernest Gellner, from whom he seems to have inherited an interest in what has sometimes been called the "Grand Question," namely why, after several millenia of agrarian stability in the grip of the kings and priests (or sword and book, as Gellner metonymized those elements of agrarian society in his excellent Plough, Sword and Book: The Structure of Human History), some human societies (i.e., Western Europe) should have broken out of the cycle of agrarian power politics and begun to achieve unprecedented economic growth, with all the attendant political and social effects that make up the "modern" world.

In an earlier book, The Riddle of the Modern World: Of Liberty, Wealth and Equality, Macfarlane presents and analyzes the thoughts of Montesquieu, Adam Smith, and Tocqueville, as they attempted to understand and describe what was happening to their world (a series of Macfarlane's lectures to Cambridge undergraduates on these and related thinkers is available on Macfarlane's Youtube channel, and is worth seeking out). This book, The Making of the Modern World, extends the work of Riddle by essentially doing the same for two much lesser known thinkers, F.W. Maitland and Yukichi Fukuzawa.

The selection of subjects is not arbitrary. Whereas the earlier thinkers were speculating about contemporaneous changes, these late 19th century thinkers had more perspective, and more historical data, with which to work. Unfortunately, not much else ties Maitland and Fukuzawa together, so that The Making of the Modern World essentially forms a dual volume of independent studies (a fact Macfarlane has since recognized by publishing each monograph separately, in substantially the same form, as a free e-book on his website; also available for purchase under the titles Secrets of the Modern World: Author Name).

I.

Legal historian F.W. Maitland (1850-1906) is not often ranked among the political philosophers, but Macfarlane's presentation suggests that he should be (a view that is impliedly endorsed by the publication in 2003, a year after Macfarlane's work, of Maitland: State, Trust and Corporation (Cambridge Texts in the History of Political Thought)). Maitland took on fundamental questions, but he did so through "learning wide and deep, tough and technical" (p. 23), steeped in centuries-old legal records interposing their difficulties of "the hand-writing, the dog latin and law-french, the abstruse forms of procedure and technical terms," all requiring that he "reconstruct a largely vanished world-view in order to understand them" (p. 35).

And what were the fundamental questions for which Maitland sought answers in Norman and Plantagenet law books? Chiefly, it was the source of England's divergence from continental political trends which, by the 16th and 17th centuries, were pointing towards the primeval traps of agrarian society, the capture of wealth by a predatory ruling and military class with an attendant suppression of commerce and invention. Broadly, Maitland attributes this divergence to the difference between English common law and the Roman civil law that was adopted across northern Europe between the 12th and 16th centuries (see p. 75). In Maitland's words:

"The English common law was tough, one of the toughest things ever made. And
well for England was it in the days of Tudors and Stuarts that this was so.
A simpler, more rational, a more elegant system would have been an apt
instrument of despotic rule" (qtd. p. 76)

The trust is perhaps the prime example. In the trust, Maitland thought he had discovered a key, perhaps the key, to civil society. The trust, unlike the corporation, allows private citizens to form durable legal associations without the consent of the state, effectively building powerful entities in society that buffered the individual from the state. Roman civil law, apparently, knows the corporation, but not the trust. But the very messiness of English jurisprudence allowed this subversive entity to develop in the interstices of law and equity, until Henry VIII tried, unsuccessfully, "to crush it in the Statute of Uses (1535). But the horse had already bolted" (p. 91).

As this probably inadequate precis suggests, much of the discussion of Maitland's work is necessarily technical, and may put off a reader otherwise interested in these grand historical questions. Macfarlane even theorizes that this explains Maitland's obscurity: his "profound sociological and philosophical analysis was covered over with a veneer of technical legal history which has deceived subsequent historians into thinking of him just as a historian or legal historian" (p. 120).

I think Macfarlane goes a long way in this book towards stripping off that veneer and revealing Maitland's profundity. He is workmanlike in his presentation. He is no prose stylist, and as he notes at the outset, he has quoted extensively from his subjects, to let them "talk to us in their own words" (p. x). In some contexts, this practice can be tedious (indeed, I think it probably is so in Riddle, where Macfarlane is discussing much better-known thinkers), but here it serves the reader well, given both Maitland's obscurity and his fragmented and voluminous oeuvre. Macfarlane has done yeoman's work in pulling together themes that may be only latent in the pages of Maitland's technical legal history, and this book serves as a valuable introduction to Maitland for the non-lawyer reader or student.

II.

Shamefully, I had never heard of Yukichi Fukuzawa, whose importance in Japan is indicated by his image being carried on one of the two modern Japanese banknotes (p. 140). He is a fascinating individual, but largely because he was in the thick of the fascinating period in which Japan made a rapid transition from feudal agrarian society to a Western-style commercial-industrial society. Owing partly to character, partly to circumstance, he was an early learner of Dutch and then English (a very strange thing to be in his society), which put him in an insuperable position to be an expositor of "the West" to the Japanese.

Macfarlane carefully describes Fukuzawa's life, his work, and the society in which he lived, and he helpfully identifies common themes in Fukuzawa's thought and that of other thinkers (e.g., Smith, Tocqueville, etc.) observing the same transition in other times and places. He is to be commended for "introducing [Fukuzawa] to an English-speaking audience" despite his own avowed limitations (e.g., not reading Japanese) (p. 140), given that at the time of publication (2002) there was no book-length study dedicated to Fukuzawa. Two such books have since appeared (Fukuzawa Yukichi: From Samurai to Capitalist (Library of World Biography Series); Civilization and Enlightenment: The Early Thought of Fukuzawa Yukichi), which perhaps were spurred by Macfarlane's foray into the field. Regardless, given Fukuzawa's importance in Japan and the relative paucity of English-language literature on him, it is no harm to have Macfarlane's non-specialist study available as well.

An Interesting Discussion of the Theology and History of the Articles

Oliver O'Donovan offers an interesting and theologically insightful discussion of the 39 articles mainly in the context of 16th century England. He goes through the themes of the articles and identifies some of the thinking, history and tensions behind them. O'Donovan is almost entirely a fan of the articles; although, he also points out where he thinks they fall short. He adeptly highlights the areas where the articles shine in their wisdom and simplicity. His book will give readers a better understanding and appreciation for the articles, as well as a knowledge of their intended purpose within the newly formed Church of England of Cranmer's time.

Although this book appears to be out of print, it definitely recommends O'Donovan's more recent offerings.

About the Author
Gordon Grant holds a Research Chair in Cognitive Disability in the School of Nursing and Midwifery, University of Sheffield, and Doncaster and South Humber Healthcare NHS Trust. His main interests concern family caregiving of vulnerable groups and the support needs of people with severe and complex learning disabilities.
John Keady is Senior Lecturer in the School of Nursing and Midwifery at the University of Wales, Bangor. John's main interests are in the needs of people with dementia and their carers' and service responses to these needs.

Ulla Lundh is Docent and Senior Lecturer at the Unversity of Linkoping, Sweden. She has particular interests in the needs of older people and their carers and has been engaged in several studies that have sought to develop partnerships between family and formal caregiving systems.

Mike Nolan is Professor of Gerontological Nursing at the Unversity of Sheffield. He has long-standing interests in the needs of family carers and of vulnerable older people in a range of care environments, and has published extensively in these areas.

In recent philosophical discourse, there has been a proliferation of work in the field of philosophy of religion, and in particular at the intersection between epistemology and philosophy of religion. Much of that interest has centred on the emergence of what has come to be known as 'Reformed Epistemology'. The central claim of Reformed epistemologists is that belief in God is properly basic. The purpose of the arguments offered by Reformed epistemologists is to oppose what Plantinga calls the 'de jure' objection to theistic belief - the idea that it is somehow irrational, a dereliction of epistemic duty, or in some other sense epistemically unacceptable, to believe in God. This objection is distinct from what Plantinga labels the 'de facto' objection - the objection that, whatever the rational status of belief in God, it is, in fact, a false belief. The primary goal of Reformed epistemology, then, is to defend Christian belief against the de jure objection, thereby showing that everything really depends on the truth of Christian belief. This book demonstrates the feasibility of combining the Reformed epistemologist's position with an argument for theism that the author draws from Charles Taylor's work. In it, he shows the value that would be added to the Reformed epistemologist's position by such a combination.

Reformed Epistemology and Phenomenology? Yes!

Baker makes a move that most people never saw coming. He puts together the recent project in religious epistemology called "Reformed Epistemology" and the moral phenomenology of Charles Taylor. His hope is to further answer the de jure objection to theism--the claim that theistic belief is irrational. The first half of the book is an excellent overview of the main ideas in Reformed Epistemology which is an externalist theory of knowledge and human rationality. A few chapters are dedicated to examining the work of the Reformed Epistemologists Nicholas Wolterstorff, William Alston, and Alvin Plantinga.

In the second half of the book Baker expounds upon the work of Charles Taylor in moral phenomenology. Taylor's work is meant to capture the essence of human moral experience. Taylor goes on to argue that this moral experience makes the best sense if God exists.

The last section of the book is where Baker brings everything together to answer the de jure objection to theism. It is a brilliant move. I am interested to see what kind of reception Baker's work receives in the scholarly world.

I have already written a detailed review essay on this book, which should soon be published. I will only offer a precis here. In this remarkable book, Deane- Peter Baker accomplishes three interesting things. First, he brings two of the most extraordinary philosophers of our time into conversation with one another. Plantinga and Taylor are both both devout Christians and brilliant thinkers; there, the similarity ends. Plantinga is an analytic philosopher of religion, who concentrates on metaphysics, logic, the Philosophy of Religion,and epistemology. Taylor, in contrast is a polymath, who has made contributions to almost every branch of philosophy,and to a number of disciplines outside of philosophy as well.. In this Tour de Force, Baker shows that these very different philosophers share common concerns and a common aim.
This brings us to Peter-Baker's other two achievements. First, this book does much to bridge the gap between "analytic" ( Plantinga) and "continental" (Taylor) philosophy. Even more important, he shows how combining Taylor's and Plantinga's ideas can help us to fashion a powerful new argument for Christian Theism .

This book is a rare and compelling exploration of how blind and sighted persons imagine the invisible. The author probes what it means for anyone to lose one’s world, and argues for why our notion of disability demands a widening of the human. In so doing, the book is both a window and a mirror.
As a window, it reveals the author’s desire for inner healing “that comes from acceptance, from inclusion, from the breaking down of barriers through mutual understanding, for acceptance of different worlds, of different kinds of human life.”
As a mirror, it shows how and why we readers come to regard blindness “in the light of our unconscious cultural constructs.” Thus, it challenges our concepts of what is normal and fully human, and what it means to be impaired.
In many ways this is not an easy read because it pricks our pretenses. Yet, it is above all a work of hope because, true to his own calling as a teacher, John Hull concludes his work with a firm conviction that teachers, by their “experience, familiarity and imagination” can cross over into the lives of another human being and “enter into several worlds.” Such teaching, he argues, contributes to building a better world in which it will be easier to accept varieties of normality. For sighted and blind persons this book is a rare gift and an elegantly argued challenge. I recommend it for students and teachers alike for their mutual pondering.

The Tactile Heart presents an alternative way of looking at the Bible as well as life in general. Most of us are sighted. We read the Bible and live our lives from a sighted worldview. Hull provides us with a look into a nonsighted world, and alternate worlds in general. This plurality of worlds allows us to be inclusive and to have compassion and empathy for others in ways that are not normally possible for us. A worthwhile book, thought-provoking and mind-expanding.

The focus of the discussion is placed on issues such as minority rights, education, religious tolerance and the trend to global homogenization. Running through the description of these issues in an implicit critique of the loose way in which the word culture is used to mean an unchanging set of definitive characteristics and how that usage bedevils discussions of multiculturalism. The result is a concise and balanced overview of a topic with wide appeal across undergraduate and postgraduate courses from sociology and politics to cultural studies and anthropology.

About the Author
C. W. Watson is Senior Lecturer in the Department of Anthropology at the University of Kent at Canterbury where he has taught for the past twenty years. Prior to that he worked in universities in Malaysia and Indonesia. Having moved into social anthropology from an education in arts and letters he has always tried to employ a multidisciplinary perspective in pursuing his research which ranges from studies of Islamic politics in Indonesia to theoretical analyses of ethnography. His doctoral research was on kinship and property among the Kerinci people of the highlands of central Sumatra. His latest book is Of Self and Nation: Autobiographical Representations of Indonesia (2000).

'Materialistic naturalism has, for some years, been the received wisdom in philosophy, as well as amongst much of the educated public. Many serious philosophical arguments have been brought against this ideology, but usually in a series of separate controversies. Professor Moreland’s great service is to bring all these objections together, whilst adding his own original contributions, in a very effective anti-naturalist polemic. He shows us that the materialist world picture cannot accommodate the most basic phenomena of human life: It has no place for consciousness, free will, rationality, the human subject or any kind of intrinsic value. Materialism does not disprove these human realities, it is simply incapable of accounting for them in any remotely plausible way. I would add to the list of its failures that naturalism lacks even a coherent account of the physical world itself. A Superb Critique of Naturalism

J.P. Moreland's The Recalcitrant Imago Dei is a work that outlines a case against naturalism based on what a Christian would define as the "image of God." These recalcitrant (as far as naturalism is concerned) facts include consciousness, free will, rationality, a substantial soul, objective morality, and intrinsic value.

J.P. Moreland has, I believe, outlined a rather magnficent critique of naturalism in this work. Chapter by chapter, he lays out philosophical defeaters for naturalism that are based on some of the most basic facts of human life. Each chapter contains clear, though often intellectually challenging, arguments against naturalism based on such things as consciousness or free will.

The chapter on Consciousness was, I believe, great, but I've read almost all the material in other works (specifically, J.P. Moreland's Consciousness and the Existence of God and William Lane Craig/Moreland's Blackwell Companion to Natural Theology). I believe that current apologists are certainly on to something when they consider the argument from consciousness, which I would consider a rather impressive defeater of naturalism. Moreland's version of the argument is actually an argument for theism, and as far as I'm concerned, that makes it even better.

The next chapter considers the case of the freedom of the will. I believe that Moreland is correct in suggesting that naturalism generally, and physicalism specifically are almost certainly defeaters of the freedom of the will. Morelands argument in this chapter is again similar to some of his other works (here it would be Philosophical Foundations for a Christian Worldview), but there is some material here that is both not recycled and very useful. I believe that this is a chapter I will continue to open to in my debates with physicalists.

One argument that continues to pique my interest is the argument from rationality. In this chapter, Moreland doesn't so much employ an argument from reason for the existence of God as he uses the existence of reason as a defeater for naturalism. I believe many of the aspects of the argument from reason tend to mirror some of the teleological argument's claims, and because of this I generally am biased against it, but I find Moreland's methodology of using it against naturalism rather than as a proof for God quite interesting and will probably use it in application.

The chapter on the substantial soul is, I believe, less useful as an argument against naturalism (I think naturalists who argue that the soul is a physical object are, well, generally ignored nowadays), but the chapter contains several pages of highly useful definitions. It's another chapter I will almost certainly continue to open to in order to clearly outline my responses.

Objective morality is a continual problem that I don't see naturalism having any way around. I'm a huge advocate of the moral argument, and while Moreland doesn't advance any specific moral argument in this chapter, he uses the idea of objective morality as a defeater for naturalism (and vice versa). Further, he argues that naturalism has no way to give humans intrinsic value, due to the idea that, according to naturalism, humans are merely animals and have no significant differences between them and, say, a dog as far as the physical world is concerned. His discussion in this chapter and the previous chapter on the errors of various philosophers using species relations when they should be discussing genus relations is highly interesting, though I'm unsure of the applicability.

The appendix has a few useful things, but it is mostly just Moreland observing various philosophical trends. He does offer an argument against naturalistic dismissivism that I will probably make use of in the future.

Overall, The Recalcitrant Imago Dei is a fantastic work. Although some portions of it are clearly recycled, including almost an entire chapter, it is a work that I will almost certainly use again and again. Moreland's style of writing is almost always clear, but he sometimes suffers from an overuse of philosophical terms that are usually obvious in meaning, but could probably have been better said in a simpler fashion (like qualia, desiderata, etc.). I got this book hoping it would have some good arguments in it to help formulate a general critique of naturalism and I was not disappointed. I recommend this book highly, but be aware of the fact that it is certainly not easy reading.

Excellent Philosophical Critique of Naturalism

This book is a concise, deep, challenging, and wide-ranging critique of philosophical naturalism. It argues that there are several aspects of reality which naturalism is unable to account for but that theism can: consciousness, free will, rationality, morality, value, and a substantial human soul. The arguments are controversial and many will disagree, but I would urge anyone who has the time and inclination to read and think about this book, if you are wondering whether naturalism is the most rational worldview, or more rational than theism. If Moreland is right, and I think he is, theism has more explanatory power regarding many central aspects of human persons. I don't agree with everything in the book, of course, but the case is very well made.

Rather than summarizing the entire book, as a previous reviewer has already done, I will focus on the last chapter which is entitled "Naturalism, Objective Morality, Intrinsic Value and Human Persons." Moreland begins the chapter by noting 3 features of the moral order:

1. objective, intrinsic value and an objective moral law;

2. the reality of human moral action; and

3. intrinsic value and human rights.

His claim is that these features of moral reality fit very well within a biblical theistic worldview. By contrast, some naturalist philosophers believe that naturalism yields defeaters for these aspects of moral reality. Moreland alludes to naturalists John Bishop and Michael Ruse as examples of such philosophers. (As a side note, other naturalists, such as Erik Wielenberg, would disagree. But Moreland's points count against a naturalist view which seeks to accomodate such non-natural properties within its ontology if he's right that these features have better metaphysical fit within a theistic framework.)

Moreland offers an argument that the following features are defeaters for a naturalist worldview. To fully appreciate and evaluate his argument of course requires reading the chapter in the book, but I'll give a quick summary of his points.

1. The existence of objective moral value: If the universe starts with the Big Bang, and over its history we find the arrangement of microphysical entities into increasingly complex physical compounds, how does value arise? How can a naturalist, as a naturalist, embrace non-natural, objective, values?

2. The nature of the moral law: The moral order presents itself imperatively, that is, as something which commands action. The sense of guilt one feels for falling short of the moral law is best explained if a good God is the source or ultimate exemplification of that law. As Moreland puts it, "One cannot sense shame and guilt towards a Platonic form (p. 147)."

3. The instantiation of morally relevant value properties: Even if a naturalist allows for the existence of some Platonic realm of the Forms, the naturalist has no explanation for why these universals were and are instantiated in the physical universe.

4. The intersection of intrinsic value and human persons: How is it that human beings are able to do as morality requires, and that such obedience to the moral law also happens to contribute to human flourishing? Theism has an obvious answer to such questions, but it is not clear, and is far from obvious, how naturalism would account for this.

5. Knowledge of intrinsic value and the moral law: Given that such values are not empirically detectable and cannot stand in physical causal relations with the brain, how is it that we could know such things? Evolutionary explanations fall short because of what is selected for in such processes on naturalistic versions of evolutionary theory.

6. The nature of moral action: Here, I will simply quote Moreland, "...evolutionary naturalism would seem to predict a world of wantons. Since genuine moral agents understand moral duty and conflicts involving moral duty, wantons cannot be depicted as such. What is at issue is whether evolutionary naturalism has the intellectual resources to avoid implying a wanton world. In my view, evolutionary naturalism does not have those resources (p. 153)."

7. An adequate answer to the question, "Why should I be moral?": Both naturalists and theists can respond, "Because it is the moral thing to do." But beyond this, when thinking about the question outside of the moral point of view, the issue becomes why is it rational to adopt the moral point of view rather than an egoistic one? According to Moreland, this is a problem for the naturalist. But the theist can offer a variety of reasons to adopt the moral point of view--the moral law is true; it is an expression of the non-arbitrary character of a good, loving, wise, and just God; and we were designed to function properly when living a moral life.
The rest of the chapter includes a discussion of the value of human beings and rights, and I'll leave it to the interested reader to explore.

The book is easily worth the price, and I highly recommend it for those inclined to do the work of reading and considering the arguments it contains.

Worth $100. $40 is a steal. But you won't believe me until you read it.

It is sad that the book is outside of the $20 comfort-zone of most wallets. Many people will find this book tempting based on reviews and descriptions, then pass it up because of the expense. Do not be one of those people if the topics involved interest you. This book is gold. The previous reviewer said all that really needs saying. I will add that Moreland's book does not so much prove that God exists so much as it proves that atheistic naturalism ("physicalism") is intrinsically untenable (or at least unreasonable) for obvious reasons not often considered. That is enough to seriously altar the nature of the philosophical dialogue between the theist and the atheist.
